$50.00 to $200.00 dollars per day of noncompliance, revocation of the permit and
forfeiture of the reclamation warranties.
Please be aware by rule a Notice of Intent (NOI) can not be transferred to another
company or individual. Should Bluerock sell claims or areas under a DRMS NOI the
only way for Bluerock to be released from its financial warranties will be full reclamation
of the sites or if a new notice covering the same area is filed by another entity and
approved by DRMS.
Communication between Bluerock Resources /Energy and DRMS is critical. DRMS
will help to ensure that any transfers of permits can be done quickly and efficiently but
can only do so if all required information is submitted and it knows who to contact.
DRMS staff realizes that the situation is difficult. However, the main priority must be
protection of the public and environment by maintaining compliance on all mine and
prospect sites.
If you need additional information, please contact me at the Division of Reclamation,
Mining and Safety, Grand Junction Field Office, 101 S. 3rd St., Suite 301, Grand
Junction, Colorado 81501, telephone no. 970.241.1117.
Sincerely,
G.
