Division Director <br />Hayden, Colorado 81639 Natural Resource Trustee <br />Re: Seneca II-W Mine (C-1982-057) <br />Technical Revision No. 62 (TR-62) <br />Division of Water Resource Comments <br />Dear Mr. Karo: <br />Enclosed please find a copy of comments received from the Division of Water Resources regarding TR- <br />62, specifically the augmentation plan for the Friederich springs and retention of permanent ponds and <br />stock tanks. The comments note that SCC has not provided information regarding the adjudication of <br />water rights or a plan to augment or replace water on a permanent basis, and recommends that SCC either <br />obtain a State Engineer's approved water supply plan or court approved augmentation plan, or install a <br />device for stream flows to bypass the dam structure or outflow device at the base of the dam structure to <br />release inflows when a call is placed on the system. These comments are similar to those items <br />mentioned in Item 6c of our February 18, 2009 adequacy letter. Please submit the requested information <br />to us, and we will forward it to the Division of Water Resources for their review.
