Cattany <br /> Division Director <br />RE: Mountain Coal Company, LLC Natural Resource Trustee <br />Notice of Intent to Explore (NOI) <br />File No. X-2009-212-08 <br />Dear Mr. Koontz, <br />The Division has reviewed the above-referenced NOI in accordance with the applicable provisions of <br />the Colorado Surface Coal Mining Act ("Act") and the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining ("Regulations), and has the following comments. <br />According to Rule 2.02.1 a Notice of Intent for coal exploration is established for areas OUTSIDE an <br />approved permit area. NOI X-2009-212-08 falls within the West Elk Mine (C-1980-007) permit area. <br />Due to the fact that the exploration activities proposed in NOI X-2009-212-08 fall within an approved <br />permit area, the activities would constitute a Minor Revision to the West Elk Mine's active permit. <br />Tom Kaldenbach will provide Colorado Division of Reclamation, Mining and Safety review the <br />revision submitted to the Division.
