Notice of Intent to Explore (NOI)
File No. X-2009-212-08
Dear Mr. Koontz,
The Division has reviewed the above-referenced NOI in accordance with the applicable provisions of
the Colorado Surface Coal Mining Act ("Act") and the Regulations of the Colorado Mined Land
Reclamation Board for Coal Mining ("Regulations), and has the following comments.
According to Rule 2.02.1 a Notice of Intent for coal exploration is established for areas OUTSIDE an
approved permit area. NOI X-2009-212-08 falls within the West Elk Mine (C-1980-007) permit area.
Due to the fact that the exploration activities proposed in NOI X-2009-212-08 fall within an approved
permit area, the activities would constitute a Minor Revision to the West Elk Mine's active permit.
Tom Kaldenbach will provide Colorado Division of Reclamation, Mining and Safety review the
revision submitted to the Division. Upon the approval of the revision, the Division will request a letter
to withdraw NOI X-2009-212-08.
