III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was an aerial inspection of the McClane Canyon Mine conducted by Harry Ranney of the <br /> Division of Reclamation, Mining and Safety(DRMS). Aerial photographs were taken on <br /> February 19, 2009 at approximately 4:04 p.m. Weather conditions appeared to be clear and <br /> sunny at the time of the flight. Five photographs were taken during the flyover. Mike Boulay of <br /> the DRMS reviewed the aerial photographs. <br /> The portal area of the mine site, coal waste storage area, sediment pond, and the office location <br /> were all visible in the photographs. Coal was being hauled from the mine site at the time of the <br /> flight. The only activity discernible in the photograph is at the coal stockpile where a loader was <br /> actively working preparing to load coal onto a haul truck. <br /> Ground conditions at the mine site were partially snow covered but facilities areas had been <br /> cleared of snow and appeared to be dry. The portion of the mine site haul road visible in the <br /> photograph was dry, and appeared well maintained and in good condition. The portal facilities <br /> area is also well maintained. All site locations visible in the photograph appeared stable and no <br /> significant erosion or other problems were identified with this aerial inspection. <br />
