III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was an aerial inspection of the Roadside Portals Mine conducted by Harry Ranney of the <br /> Division of Reclamation, Mining and Safety(DRMS). Aerial photographs were taken on <br /> February 19, 2009 at approximately 3:49 p.m. Weather conditions appeared to be clear and <br /> sunny at the time of the flight. Mike Boulay of the DRMS reviewed the aerial photographs. <br /> Eight photographs were taken during the flyover. The portions of the mine site that are visible in <br /> the photographs include the Unit Train Loadout area, South Portals area, and the CRDA waste <br /> disposal sites (CRDA-1 and CRDA-2). Xcel Energy trucks were hauling ash from the Cameo <br /> Steam Plant to the ash disposal site adjacent to the permit area. There was no other activity <br /> discernible in the photographs. <br /> The mine site was dry. The only sediment ponds apparent in the photos were Ponds 6, 8 and 11. <br /> All of these sedimentation ponds were dry and appeared to be functional. From the photos it <br /> appears that good progress has been made in dismantling the conveyor belt structure at the UTL <br /> Loop area(see attached photo). <br /> 'The mine site roads visible in the photographs adjacent to Coal Creek were dry, and appeared <br /> well maintained and in good condition. The road up to the shop and warehouse at the South <br /> Portal was in good condition. There was no activity at the South Portal as the fruit stand and <br /> warehouse remain closed for business at this time. The facilities area and perimeter locations at <br /> the South Portal were well maintained and no problems were noted during this inspection. The <br /> Kokopelli Produce fruit stand and warehouse area at the South Portals is shown in the attached <br /> photograph. <br /> All site locations appeared stable and no significant erosion or other problems were identified <br /> with this aerial inspection. <br />
