Cattany <br />Division Director <br />Natural Resource Trustee <br />Re: Lusk Pit #36, M-2009-002, Adequacy Review #2 of the 112 Construction Materials <br />Reclamation Permit Application <br />Dear Mr. Dawson, <br />The Division of Reclamation, Mining, and Safety (DRMS) conducted a pre-operation <br />inspection at the site on February 24 h, 2009. There was one issue that was observed during <br />the inspection that will need to be addressed prior to permit approval. <br />A small two track ranch road exists on the eastern side of the permit area that was not <br />accounted for in the Pre-mining map. It is unclear if this structure will be affected during <br />the mining operation. Please describe how this structure will dealt with during the <br />mining and reclamation operation. Please state if the road will be mined through, and if <br />so, if it will be re-established or reclaimed to the specification of the reclamation plan. If <br />you do not intend to mine through the road, but intend to affect land within 200 feet of <br />the road, please obtain a damage reimbursement agreement with the owner of the road <br />per Rule 6.4.19 of the Construction Rules and Regulations as described below: <br />In accordance with Rule 6.4.19, when mining operations will adversely affect the stability <br />of any significant, valuable and permanent man-made structure located within 200 feet of <br />the affected area, the applicant will: <br />a.) Provide a notarized agreement between the applicant and the person(s) having an <br />interest in the structure, that the applicant is to provide compensation for any <br />damage to the structure; or <br />b.) Where such an agreement cannot be reached, the applicant shall provide an <br />appropriate engineering evaluation that demonstrates that such structure shall not be <br />damaged by activities occurring at the mining operation. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
