MINE ID # OR PROSPECTING ID #: nn-90nMW <br />INSPECTION DATE: 2-94-9009 INSPECTOR=S INITIALS: 11F <br />OBSERVATIONS <br />This was a pre-operation inspection of the Lusk Pit, DRMS File# M-2009-002. The operator, Baca County, <br />submitted a 112 (c) permit application on October 6th, 2009. The application was called complete for review on <br />January 16th, 2009. The decision date for this application is April 16th, 2009. The site is located about 7 miles <br />south and 5 '/z miles west of the town of Springfield, Colorado in Baca County. I, Jared Ebert of the Colorado <br />Division of Reclamation Mining and Safety conducted the inspection. <br />The proposed permit area of this site is bout 34.33 acres. The site consists of rangeland primarily used for cattle <br />grazing. A barbed wire fence surrounds the site on the west side and the south side of the permit area. The <br />proper mining notice sign was in place along the western boundary near where the proposed entrance will be <br />located. The permit boundary was marked with metal stakes and flagging. The entire site was measured using <br />a GPS unit and it appears that the boundary markers were placed correctly. A map of the Divisions findings is <br />included in this report. The topography drops quickly from the southern end of the site to the northern end of <br />the site. Based off the mine plan, it appears that the operator will mine this southern slope. <br />There is a small existing excavation on the south west corner of the mine site. This excavation is just about .24 <br />acres in size. The excavation is "L" shaped with a cut into the side of the hill leaving a highwall about 10 feet <br />in height at it highest location. This excavation exposed a very good soil profile. It appeared that the topsoil <br />ranged in depth from 4-12 inches. It appears that the rock/caliche material that will be mined is located just <br />under the topsoil layer. <br />The vegetation at the site consisted primarily of sod forming blue grama grass and yucca. Given the conditions <br />of the site, it appears that the area is heavily grazed. All the structures that were identified in the pre-mining <br />map were identified in the field. One structure that was not listed was a small two track ranch road on the <br />eastern side of the permit area (see Figure 5, and the attached map). It is unclear if this structure will be <br />affected during the mining operation. The operator will need to describe how this structure will dealt with <br />during mining and reclamation. The operator will need to determine if the road will be mined through, and if so, <br />will it be re-established. If the operator does not intend to mine through the road, but intends to affect land <br />within 200 feet of the road, they will need to obtain a damage reimbursement agreement with the owner of the <br />road per Rule 6.4.19 of the Construction Rules and Regulations.
