UPDATE <br />7his is for the renewal of the general sand and gravel permit first issued on October 28, 1982, with reissuances on June 10, 1987, August <br />31, 1992, and August 31, 1997. The General Permit system for regulating sand and gravel production operations has worked well for <br />the State of Colorado. <br />The following minor changes have been made to the permit and Rationale during renewal: <br />A. Small MunicipalitvExemption: The Rationale discussion on thestomiwaterpermittingExemptionsforSmaUMunicipalides <br />(Section III.B) has been changed to include the March 10, 200.1 deadline for permit coverage for municipally owned <br />industries.. This did not involve any changes to the permit. <br />B. Reapplication: Authorization to discharge under this general permit will expire on September 30, 2007. For certifications <br />covering stormwater discharges only (i.e., the permittee's individual certification does not indicate that Part LB of the <br />permit must be followed), the deadlinefor reapplication for continued coverage under thegeneral permit has been changed <br />to ninety-days prior to permit expiration, or June 30, 2007. The due date for permittees certified to discharge stannwater <br />and process water will remain as 180 days before permit expiration, or March 31, 2007. <br />C. A paragraph was included in the introductorypage explaining the right ofanyparty to an adjudicatory hearing contesting <br />the renewal of this general permit, as per the Colorado Discharge Permit System Regulations Regulation No. 61, (5 CCR <br />1002-61). Note that this does not provide for an attjudicatory hearing for a cert fication issued under this general permit. <br />D. Impacted Stream Segments: For this general permit, any existing or new operation that discharges to a segment that is listed <br />on the Division's 303(d) list of impacted stream segments may require an individual permit. The 303(d) segments are <br />segments in which water quality standards for one or more pollutants are exceeded. <br />For most, if not all, of the operations that discharge under this permit, there are no monitoring data to verify the expectation <br />that these discharges will not impact a listed segment. Therefore, for those facilities that discharge process water to <br />segments on the 303(d) list, the permittees will be required to perform a one-time analysis upon commencement ofdischarge <br />for the listed parameters of concern to confirm that stream standards for these parameters are not exceeded in the discharge <br />concentrations. <br />Where the receiving water is included on the state's 303(d) list, total maximum daily loads (TMDLs) are being developed in <br />accordance with the Division's schedule for TMDL completion. Once a TMDL has been established, if it is necessary to <br />incorporate limitations for a facility certified under this general permit which are based upon the outcomes of the TMDL or <br />the results of the one-time analysts, an individual permit may be written to regulate dischargesfrom this facility. Thefacility <br />would continue to be covered under this general permit certification until the individual permit is issued. <br />Il. STORMWATER PROGRAM <br />As required under the Clean Water Act amendments of1987, the Environmental Protection Agency (EPA) has established a framework <br />for regulating municipal and industrial stormwater discharges. This framework is under the National Pollutant Discharge Elimination <br />System (NPDES) program. The regulations (40 CFR 122.26) require specific types of industrial facilities which discharge stormwater <br />associated with industrial activity (industrial stormwater), to obtain coverage for this discharge under an NPDES permit. Facilities <br />which discharge industrial stormwater either directly to surface waters or indirectly, through municipal separate storm sewers, must be <br />covered by a permit.
