This responds to your letters of August 28, 2007 requesting site disqualification under the
authority conferred to the U.S. Fish & Wildlife Service (Service) by the Endangered Species
Act of 1973 (ESA), as amended (16 U.S.C. 1531 et seq.). The Service has reviewed the
Preble'.s Meadow Jumping Mouse Habitat Evaluation; and Plant Habitat Evaluation for
Spiranthes diluvialis r the Proposed aggregate e-wraction cite in Weld County, Colorado.
Based on the information provided, the Service agrees that populations of Spiranthes
diluvialis or Zapus hudsonius preblei are not likely to be present in the area. Thus, the
proposed project is not likely to adversely affect Ute ladies' tresses orchid or Preble's.
Therefore this site is disqualified for consideration under provision of ESA. Should project
plans change or additional information regarding listed or proposed species become
available, this determination may be reconsidered under ESA.
On February-'), 2005 the U. S. Fish and Wildlife Service issued a 12-Month finding on a
petition to delist Preble's. Because of the complexity involved, the Service has extended its
original proposal. Until a final determination is made, Preble's remains protected under ESA.
