Bear, Jr. <br />Bowie Resources Limited <br />2768 Compass Drive, Suite 101 <br />Grand Junction, Colorado 81505 <br />Dear Mr. Bear: <br />We are responding to a request by Mr. Jim Stover of Stover <br />and Associates on your behalf for a Department of the Army permit <br />for Bowie Resources Limited to impact 0.33 acre of jurisdictional <br />waters of the United States to construct two sediment ponds and <br />an access road for the Bowie Number 2 Mine. The project is <br />located within Sections 9, 10, 11, 14, 15 and 16, Township 13 <br />South, Range 91 West, Delta County, Colorado. <br />The Chief of Engineers has issued nationwide general permit <br />number 21 which authorizes the discharge of dredged or fill <br />• material in waters of the United States for surface coal mining <br />activities. Your project can be constructed under this authority <br />provided the work meets the conditions listed on the enclosed <br />information sheets and the following special conditions: <br />1. Insure compliance with all conservation methods in the <br />Fish and Wildlife Service's Biological Opinion number ES/OSM GJ- <br />6-CO-96-F-011, dated September 3, 1996. <br />2. The permittee shall reclaim the ephemeral drainages <br />impacted to pre-construction contours following the life of the <br />project. <br />3. To compensate for the loss of wetlands associated with <br />this project you have agreed to mitigation at a 1:1 ratio of <br />wetlands impacted to wetlands created. This authorization is <br />contingent upon Corps' approval of a final mitigation plan prior <br />to wetland disturbance. The approved mitigation plan must be <br />implemented concurrent with project construction in <br />jurisdictional wetlands. <br />The Corps of Engineers has made a determination of "no <br />effect" on threatened or endangered species for this project. <br />This permit verification will be valid until February 26, 1998. <br />You should contact this office if work will extend beyond this <br />'• date. You must also notify this office in writing within 30 days <br />after project completion that the work was performed in <br />accordance with this authorization. <br />
