Volume III, Tab 1 <br />• <br />ACCESS AGREEMENT <br />/~'trt <br />THIS ACCESS AGREEMENT, dated as of the ~ day ot-hYarCh, 2005, is by and <br />between William G. Hughes (Owner herein), whose address is 16872 Farmers Mine Road, <br />Paonia, CO 81428 and Bowie Resources, LLC (BRL herein), whose address is P.O. Box 483, <br />Paonia, CO 81428. <br />W ITN ESS ETH: <br />WHEREAS, Owner is the vwne~ of certain property in Delta County, Siate of Colorado <br />which shown on Exhlhit A and described on Exhibit B attached hereto and made a part hereof <br />{lhe Properly herein); and <br />WHEREAS, BRL's desires to establish through the Property for monitoring, maintenance <br />and drilling activities. <br />WHEREAS, BRL requires access through the property for at least 10 years after mining <br />ceases at the Bowie No. 2 and 3 Mines. <br />WHEREAS, Owner is willing io permit BRL to go upon and through the Property under <br />the terms and conditions herein contained. <br />• WHEREAS, Bowie desires to extend mine workings beneath a portion of the Property. <br />Bowie agrees it will not to extend its mine working within any area that will cause damage <br />to the Owners cabin. <br />NOW, THEREFORE, in consideration of the premises, the receipt and sufficiency <br />whereof are acknowledged by each of the parties hereto, it is agreed as follows: <br />1. Owner hereby grants to BRL, its employees, agents and contractors, the right to <br />go upon and through the Property on the Hughes' Roads shown on Exhibit A. <br />2. BRL agrees to upgrade and maintain the Roads during the term of this <br />agreement. <br />3. The term of this agreement shall commence at the date of execution of the <br />agreement and continue for ten calendar years, with the option to extend the agreement for <br />additional ten-year increments. <br />4. BRL shall pay Hughes $500 upon signing of this Agreement and at the <br />anniversary of this Agreement for the term of the Agreement. <br />5. Bowie agrees to pay for any damage to Owners cabin, waterline and other related <br />facilities resulting from subsidence caused by fts mining actlvties. <br />6. BRL agrees to allow Hughes fo Hunt on the BRL Property, for two seasons with <br />three guest hunters.
