• 2.05.6(6) <br />Mine induced seismic activity could possibly cause the Bruce Park <br />landslide to negatively affect the Terror Creek Reservoir. If the entire <br />landslide mass entered the reservoir it would displace approximately 40 <br />acre-feet of storage. <br />Ponds could be damaged and drained by a subsidence crack that occurred <br />directly below the pond. The probability of such an event is very low. Any <br />pond affected by a subsidence crack could be repaired by lining the pond <br />with an impervious material such as bentonite or synthetic liner material. <br />Springs could be damaged by subsidence cracks in the impervious layer <br />below the springs which would cause them to drain to the formation below. It <br />may be possible to repair a spring that is affected by a subsidence crack. <br />First the flow interrupting crack would have to be located. Then an <br />impervious liner would be installed to seal the crack. Then the spring would <br />be developed with the use of perforated pipe and pervious gravel. <br />The Division of Water Resources recognizes beneficial use as the use for <br />which a water right is claimed such as irrigation, domestic, stock watering, <br />industrial etc. The District Court determines through the ruling of the Water <br />Referee that water has been appropriated and applied to beneficial use. The <br />Operator's private springs in the permit and adjacent area, J & M Springs <br />and Pipelines Nos. 1 through 5 and Bowie Spring S-3 have been put to <br />beneficial use. The USDA-FS has eight decreed water rights within the <br />permit boundary and two decreed water rights in the adjacent area. <br />Disruption of perched water bearing zones will occur due to mining where the <br />water bearing zones lie in the immediate vicinity of the mine roof. Because <br />of the nature of this groundwater, this does not constitute any affect on <br />groundwater resources. The local perched water-bearing zones would be <br />disrupted, but are limited in extent and are not put to beneficial use.
