MINING & <br />Travis, <br />It is our desire to obtain a technical revision to allow us to mine at the existing <br />depths, which vary on the top side with the topography of the site. We wish to keep with <br />the original plan with the floor at the original level and drainage of 1% to the southwest. <br />Currently the south side has been raised significantly to retain all runoff as required by <br />the storm drain requirements. When this is not a problem this area will be taken back to <br />the original level. It is our desire to continue the use of track hoes and excavators to <br />bench as it is easier to segregate the different products we make out of the different seams <br />or layers of natural material, located at different depths. Any areas that are dug steeper <br />than 3H:1 V will be backfilled to 3H:1 V with the overburden material and excess material <br />from screening and material that is not of quality to be crushed, all used is backfill <br />material in the final grading. <br />At your request we have hired a surveyor to map everything, as it exists in <br />heights and depths. At this time that work has been completed on the ground, but has not <br />been completed in map form and probably will not be completed before your March 2nd <br />deadline, so as soon as that data and map has been completed I will forward a copy to <br />you ASAP. The bond of $19,969.00 was done January 23, 2009, so hopefully that takes <br />care of that concern. <br />Find enclosed a check for $216.00 for the necessary fee to process a technical <br />revision. The following enclosed pages, cover a short history of how and why we are at <br />the existing point we are and a little better detail on the future mining plans. We have <br />started some sloping on the east side and will continue around to the north side as <br />weather and time permits, but probably will not be complete before the March 2nd <br />deadline, so if we cannot do some kind of technical revision we will require an extension <br />of time to complete the necessary corrective items. <br />Hopefully I have addressed most of the items of your concern, if I have missed <br />some items let me know and I will try to address them, as best I can. <br />Sincerely, <br />Leon Moores
