<br />Colowyo's Comments - 20 January 2009 Partial Inspection Report <br />Hydrologic Balance: The Division made notes in the inspection report that refer to the five <br />sumps located in Taylor Draw. Colowyo would like to clarify the status of the five sumps <br />mentioned within this section of the inspection report since these sumps have been labeled <br />and managed as Best Management Practices (BMP's). Colowyo wants to ensure these <br />sumps remain classified as BMP's and not permitted structures. <br />Backfilling and Grading: The Division commented that "The Operator was performing <br />backfilling and operations in the Section 4 area of the west Pit at the time of the inspection. <br />The operator was loading spoil from a temporary pile with a loader and dumping it along the <br />east edge of the pit just above the East Taylor Pond. The Material was then being pushed <br />into the pit by a D 11 dozer. A very small portion of the area has reached final contour. No <br />other backfilling operations were being performed in the West Pit. Colowyo agrees with the <br />majority of this observation made by the Division. Colowyo is assuming that the "small <br />portion of the area that has reached final contour" refers to the 42.2 acres of re grade that <br />Colowyo performed in 2007. Colowyo would like to mention that other backfilling <br />operations are on going in the West Pit as witnessed by the majority of this area (Sections <br />3,4 and 9) having been dumped and backfilled very close to final contour so that minimal <br />work will need to be done to complete final re grading of these acres. <br />Topsoil: The large topsoil pile just north and east of the C-C' underdrain of the East Taylor <br />Fill has been dressed and sloped by Bower Brothers. They have also cut a perimeter ditch <br />around the pile to help protect the resource. The pile still needs to be seeded and Ryan <br />indicated that they may still seed it this winter. This topsoil pile is scheduled to be seeded <br />this spring or when conditions allow safe access to and around the pile.
