Jun 25 08 08:14a
p.3
anticipated affected land in the entire lease of 1,864 acres as shown on Exhibit C-1B
(Amendment 3) in the Reclamation Permit.
To include these changes in the Reclamation Permit, a technical revision would
be provided to the Division of Reclamation, Mining and Safety if the Use by Special
Review is approved by Arapahoe County. That revision would formalize these changes
and make them a part of the Reclamation Permit. At that time, the bonding would also be
adjusted to reflect these new acreages.
The parties understand that this agreement is necessitated by the compromises
necessary to obtain the USR permit, and Schmidt has agreed to these compromises
without compensation.
l+tining leap GL 264 remains in full force and effect and only such modifications
as outlined above limit the terms of GL 264. Although this compromise reduces the size
of time twining area, it does not reduce the acreage of the lease. Schmidt maintains the
right to hold or to drop acreages within the lease boundary.
The parties below have signatory authority for this agreement.
Agre to on .lime ? 2008
Scott Davis, for Schmidt Construction Company
-414-^
Agreed to on 37e , 2008
B cha, r SLB
