7-1?V51 RECEIVED <br />TECHNICAL REVISION <br />COAL CREEK SAND RESOURCE FEB 2 3 Z009 <br />M-1988-044 pion of Reciam bon, <br />SCHMIDT CONSTRUCTION COMPANY Mk*V and Safety <br />Purpose: This revision adjusts the total area to be mined and the actual areas to be mined to <br />comply with agreements made with the Colorado Board of Land Commissioners and Arapahoe <br />County. The revision does not add affected land to the land previously approved, but does <br />remove some land from the approved affected land. To date, no disturbances have been created <br />in the permit amendment area. <br />History: When the amendment was approved, four areas were identified as being included in <br />the land to be affected. However, no local government approval had been provided at that time. <br />In the course of obtaining local government approval, many issues arose that have been <br />addressed. As a result of resolving the issues raised, an agreement was reached with Arapahoe <br />County and approved by the State Land Board that would limit the amount of disturbance to a <br />defined amount of acreage. These agreements limited the affected land in the amendment area to <br />a maximum of 300 acres. These acreages were defined on an Agreement Features Map which is <br />included in this revision. <br />New Affected Land Areas: All of the new affected land areas are included within the four <br />originally approved areas. These included areas IU, 2U, 1L, and 2L. Each of these areas have <br />been redefined with respect to the boundary of the affected land so as to provide a maximum of <br />300 acres of affected land within the amendment area. These changes have no influence on any <br />mining areas in the previously permitted area. <br />The purpose of defining these areas so precisely was to accommodate a belief that a <br />particular species of rare skipper (a butterfly group) might migrate through this area. To date no <br />skippers of this species have ever been seen, but being rare that is not surprising. Also, no actual <br />searches have ever been done to verify this species of skipper actually occurs here. <br />Following are the various effects of the redefinition of the affected land areas. <br />Area 1L: Virtually all of Area 1L has been removed from the affected land. The <br />only area still included is a narrow strip along the eastern edge of this area <br />that may be included in the footprint of a future dam to be used for water <br />storage for Rangeview. <br />Area IU: No changes will occur in this area. <br />Area 2U: Area 2U has been limited to a much smaller footprint. <br />Area 2L: The land included in this area has been reduced to a defined area that is <br />somewhat smaller than the original area. Much of this area will be within <br />the currently defined highwater level of the proposed reservoir. <br />In all cases, the affected land has been limited to those locations that extensive <br />exploration identified as potentially containing the best sand resources. <br />Technical Revision - February 2009 M-1988-044 Page 1 of 2
