M ERRILL DR. <br />PUEBLO WEST, CO 81007 <br />PHONE: 719-240-9424 FAX719-583-0768 <br />RECENED <br />FEB 2 5 2009 <br />Division of Reclamation, <br />Mining and Safety <br />RE: Request extension to correct Items # 1 under "Problems/Possible Violations and <br />Corrective Actions" listed in the Inspection Report dated 09/26/2007for WRB permit No. M- <br />1983-175, Alamosa Pit # 2, Southwest Ready Mix, Inc. <br />Dear Ms. Pickford: <br />This correspondence is to update the Division of Reclamation, Mining and Safety and yourself of <br />the progress in resolving the issues as they relate to this permit This report along with the <br />operators' calculations of what the reclamation bond would be until the approval of the <br />Substitute Water Supply Plan by State Engineer's Office (SEO). <br />The last mine site inspection was on September 26, 2007. In that inspection, you identified a <br />concern about the exposed groundwater that didn't have a Substitute Water Supply Plan <br />approved by State Engineer's Office. This issue still needs corrective action. Specifically, the <br />corrective action requires the Operator, Southwest Ready Mix, Inc. to, "Either fill the pit to at <br />least two feet above the ground water surface or demonstrate that the operation is in compliance <br />with the Office of the State Engineer". <br />The Operator was allowed to explore securing water rights sufficient to satisfy SEO possible <br />concerns. This process has taken several months and will take some months to conclude. <br />Southwest Ready Mix, Inc. is therefore requesting an additional 9 months from the date of this <br />letter to perfect the necessary water rights and to finish the Substitute Water Supply Plan <br />(S WSP). The operator has been working on this issue in good faith and has had some setbacks in <br />acquiring useable augmentation water.
