In addition to the mine site portion of the permit area, the operator leases a rail loadout from the Union <br />Pacific Railroad, located along a previously disturbed industrial site at the town on Loma, Colorado. <br />The 5.6 acre rail loadout facility located in Loma was also permitted under Permit C-1981-020. The <br />loadout facility was used infrequently, and the area disturbed by coal stockpiling and handling activity <br />was approximately 2.9 acres. The rail loadout has been reclaimed. The mine was placed in temporary <br />cessation in January 1984, and remained in temporary cessation for over 20 years. In October 2004, site <br />preparation for the small waste disposal site to handle coal waste from the adjacent McClane Canyon <br />Mine was initiated. Mine status was changed from temporary cessation to active, to allow development <br />and periodic use of the waste disposal site. <br />The permit area encompasses approximately 1028 acres (1022.4 acres in the mine area, and 5..6 acres <br />at the Loma loadout). Existing disturbed area in the mine area is approximately 17.9 acres. The <br />disturbed area at the Loma loadout is approximately 2.9 acres. Total permitted disturbed area <br />(mine/loadout combined) is 20.8 acres. <br />The coal mine waste disposal area in lower Munger Canyon was approved under Technical Revision <br />14, and involved relocation of a segment of the Munger Canyon Road. Site construction and initial <br />waste disposal occurred in the fall of 2004. Periodic haulage of coal waste from McClane Canyon <br />Mine and disposal in the Munger disposal area occurred. between late 2005 and the early summer of <br />2007. <br />Final reclamation operations were initiated in 2007 in the mine area. Backfilling, topsoiling, and <br />temporary seeding operations were completed at the mine portal area, the portal access road, the coal <br />mine waste area, and the lower road topsoil stockpile area between mid May and late July 2007. The <br />segment of the haul/access road on Bureau of Land Management (BLM) surface from the lower end of <br />the fully reclaimed portal access road down to the private land boundary was reduced in width and <br />seeded along the sides. Fencing to protect newly reclaimed sites from livestock grazing was completed <br />shortly after completion of temporary seeding. Permanent seeding and mulching of the areas graded and <br />topsoiled during the summer was completed in November 2007. Remaining reclamation is limited to <br />removal of the sediment pond and associated ditch and culvert reclamation in the coal waste disposal <br />vicinity, along with culvert removal/dry ford construction along the retained segment of the haul/access <br />road, and width reduction of the segment of the road on private land (approximately %2 mile in length). <br />This work will be undertaken following appropriate demonstration of site stabilization to allow for <br />sediment pond removal. <br />The areas for which Phase I bond release are being requested are at the Munger Canyon Mine site and <br />at the Loma loadout site. At Munger Canyon the specific areas requested for bond release include <br />15.6 acres at the portal site, haul road, portal access road, coal mine waste disposal area, reclaimed <br />topsoil pile, and the drill rig access road (Light Use Road). All of these features are shown. on the <br />exhibit titled "Munger Canyon Mine Phase I Bond Release" submitted with the bond release <br />application. The Loma loadout site consists of 2.9 acres being requested for Phase I release. The <br />Loma rail loadout site is shown on Figure 1.1-3A of the permit application package (PAP). <br />There have been no previous bond release requests filed for the Munger Canyon Mine. The Division <br />presently holds a corporate surety performance bond in the amount of $269,094.00 of which <br />$130,000.00 is being requested for release. <br />3
