Notice of Proposed Decision <br />The Colorado Division of Reclamation, Mining and Safety has issued a proposed decision to Approve <br />Bond Release Application No. 1 (SL-1) for the Munger Canyon Mine, Permit No. C-1981-020. The <br />mine is operated by CAM Mining, LLC under the provisions of the Colorado Surface Coal Mining <br />Reclamation Act of 1979. The bond release application was submitted by CAM Mining, LLC on <br />September 18, 2008. CAM Mining is requesting release of Phase I Bond liability on 18.5 reclaimed acres <br />of its total 1,028 acres within the permit boundary for the Munger Canyon Mine. The Phase I Bond <br />Release request is for 18.5 disturbed acres that have been reclaimed at Munger Canyon (15.6 acres) and at <br />the Loma loadout (2.9 acres). Of the 18.5 acres requested, the Division of Reclamation, Mining and <br />Safety is proposing to release 17.2 acres from Phase I Bond liability. The Division will not be releasing <br />1.3 acres of former haul road and surrounding area located on BLM surface at the Munger Canyon site. <br />The specific location excluded is on BLM property, from the private property line east to the <br />approximate start of the former portal access road. This portion of the former haul road was narrowed <br />by 12 feet from approximately 350 feet south of Culvert No. 6 to the private property line. Based on our <br />review of the approved reclamation plan requirements, this section of the former haul road also <br />includes the removal of culverts and replacement with low water crossings. This work is planned for <br />the future and could not be completed until the portal access and bench area were successfully <br />reclaimed because of the need for equipment access to these areas. Therefore this section of road and <br />associated ditches are not in their final reclaimed configuration and the Division will exclude the 1.3 <br />acres of surface associated with the haul road as described above from this Phase I bond release. The <br />1.3 acres associated with the former haul road on BLM land will be eligible for Phase I Bond release <br />once the culverts as shown and described in the reclamation plan are removed and low-water <br />crossings/dry fords are properly installed. <br />A Corporate surety bond in the amount of $269,094.00 is in place of which $145,860.00 is being <br />proposed for release. The affected area is located in Garfield County, approximately 18 miles north of <br />Loma, Colorado. <br />Copies of the proposed decision are available for review at the Colorado Division of Reclamation, Mining <br />and Safety office, 1313 Sherman Street, Room 215, Denver, Colorado 80203, Grand Junction Field <br />Office of the Division of Reclamation, Mining and Safety, 101 South 3`d, Suite 301, Grand Junction, CO <br />81501, and at the office of the Mesa County Clerk and Recorder. <br />Any person who has an interest which is or may be adversely affected may request an adjudicatory <br />hearing regarding this proposed decision. Requests for a hearing must be made in writing within thirty <br />(30) days of the first publication of this notice, and shall state with reasonable specificity the reasons for <br />the request and objections to the proposed decision.
