Revision 01 dated January 9, 2009 and have addressed your <br />comments. Below is ourxesponse to both of your comments. <br />1. Attached are revised versions of Exhibits C and F for the Riverbend Operation containing. the <br />information required by the DRMS Rules and Regulations. Both exhibits show the mining <br />and reclamation of Phase 9, Cell 1 which was not shown on the AMUSR=1259 maps we <br />submitted to you on December 22, 2008. <br />2. On Exhibit F the Reclamation Plans, we added a note to indicate that the Phase 8, Cell 1 and <br />Phase 9, Cell I augmentation ponds both need to be constructed with 3:1 slopes from the top <br />of the,pit to the bottom: The note can be found on sheet 3 of 3 with a leader from the note to <br />each pond. <br />We believe that these changes adequately address both of your adequacy review comments. In <br />addition, as part. of the process of updating Exhibits C and F, Tetra Tech identified a some other <br />minor adjustments we had to make to the mining cells and reclamation areas in order to leave <br />space for future.oil.and gas well operation facilities and make sure the mining cells are setback at <br />least 200' from the top of bank of the South Platte River.
