(MCC) submits the enclosed minor revision application and <br />map to reflect the subject change. <br />As we discussed February 19, 2009 in our telephone conversation, MCC will place an MDW on <br />E2-45 Pad and directionally drill to a point at E1-45 in Panel E 1. We previously had bonded for <br />14 holes on Panel E 1 and drilled 13 as shown on the attached map. The E 1-45 hole would bring <br />the total MDWs to 14 in Panel E 1. The hole is necessary and prudent for the safety and health <br />of our miners in continuing on the retreat of the longwall in Panel E 1. <br />Panel E 1 was approved with TR-111 and Panel E 2 through E 12 was approved in PR-14. We <br />believe the activity is approved by and through these permit actions. The USFS has lifted the <br />Winter Stipulation for this activity. <br />There is no bond associated with the proposed change. <br />The CDRMS form for permit application, and a map are attached to this letter of transmittal. <br />We appreciate your consideration and review of this submittal and, as always, would be happy to <br />work with you to address any questions or concerns that arise during the review process. <br />Si , <br />6 Henry A. be <br />Enviro ental Engineer <br />cc: Doug Nolte <br />Chris Hansen
