2.04.7 Hydrology Description <br />1) Adequate protection of water rights will be monitored. The Operator has <br />designed and implemented a complete hydrologic monitoring program. <br />2) Adequate protection of water rights is ensured by regular monitoring and quick <br />repair of subsidence induced problems. <br />3) Possible alternative sources ofwaterwill be utilized, if required. The Operator <br />controls 3,750 shares of Class I and 960 shares of Class II stock in the Deer Trail <br />Ditch Company and 782 shares of Class II stock in the Fire Mountain-Canal. <br />4) The Operator has two court approved augmentation plans (Case Numbers 99 <br />CW 263 8~ 02 CW 77). Case 99 CD 263 addresses the High Value Springs and <br />Ponds located on USDA-FS Managed Lands. Additionally, the augmentation <br />plan addresses the BLM's instream flow rights in Terror Creek and Hubbard <br />Creek. Case 02 CW 77 addresses sediment storage rights. The court cases are <br />presented in Volume III, Tab 2, Water Augmentation. <br />5) By agreement dated March 18, 2008, the Operator leased the Overland Water <br />Ranchers LLC 1,100 shares of the capital stock of The Overland Ditch and <br />Reservoir Company. The 1,100 shares represent 11 % of the water in the ditch. <br />The ditch typically runs 55 cubic feet per second (CFS) thus the leased shares <br />amount to 6 CFS. This water could be diverted to the Terror Creek drainage if <br />required to mitigate damage of injured parties relative tomine-related damage to <br />• the Bruce Park Dams and Bruce Park landslide. The Lease is presented in <br />Volume III, Tab 2, Water Augmentation. <br />MINE WATER INFLOW <br />The Bowie No. 2 Mine was basically dry from when the mine opened in 1997 until <br />the fourth quarter of 2002 when the mine began discharging water at a rate of <br />approximately 5 g.p.m. The inflow continued to increase with the estimated mine <br />inflow rate of 30 g.p.m. as of May 2003. This water was directed from the portal <br />areas to Sedimentation Pond C. At times the water was directed to other <br />sediment ponds if insufficient capacity was available in Pond C. However, the <br />mine water was only discharged from Pond C. <br />Water inflow into the mine is associated with sandstone channels or fractures in <br />the roof or flow from fractures in the floor. The pattern of water inflow is one of <br />steadily decreasing flow as the face mines through an area and advances away <br />from it. <br />Most areas dried up completely within several weeks of being mined. Where <br />areas didn't dry up completely, water inflow subsides to less than 1 gpm per 30 <br />feet of entry to a few areas with 1-3 gpm per 30 feet of entry. These represent <br />"damp" to "light drippers" as defined by NIOSH in their Coal Mine Roof Rating <br />System. The Bowie No. 2 Mine, D-Seam and B-Seam may also encountered <br />mine inflows from faults, fractures (if present) and perched water bearing zones <br />within the coal, the overburden, and the floor rock. <br />PR-10 2.04 - 38 - 09/26/08 <br />~$ PPRov~ <br />
