(Page 2) <br />MINE ID # OR PROSPECTING ID # M-2004-045 <br />INSPECTION DATE 1/30/09 INSPECTOR'S INITIALS RCO <br />OBSERVATIONS <br />This inspection was performed by the Division as part of its monitoring of Constructiion Materials 110 permits. The operator <br />was contacted about the scheduled inspection. The operator's representative named on page one was present during the <br />inspection. The required permit ID sign was posted at the gate near the county road, and the permit area was adequately <br />marked by T-posts. All activity appears to be within the permit boundaries. The site was not active at the time of the <br />inspection. There was no equipment onsite. <br />The site is located on several lots within a rural residential subdivision, and a subdivision road crosses the permitted area. Also <br />located on the permitted area are a fire hydrant, buried phone and electric lines (all south of the road), and immediately <br />adjacent to the permitted area (and north of the road) are a domestic well and buried water tanks. These features are owned <br />by the subdivision, which is also the permittee. Mining activity in the permitted area has not affected these structures. <br />The existing pit is north of the road, and the gravel and topsoil stockpiles are all south of the road. The area along the south <br />permit boundary, that was initial area to be mined, has been backfilled, graded and topsoiled. Establishment of revegetation is <br />the only outstanding task remaining on that portion. There were no noxious weeds observed. The operator is aware of the <br />need to address any erosion or weed infestations in a timely manner. <br />The pit is excavated with near-vertical highwalls on the W, N and E sides. Though the pit is not over 10 feet deep and <br />sloughing walls will not result in large amounts of material moving, the margins of the pit are located at the permit boundaries, <br />and could constitute a possible violation for offsite damage if the boundaries were exceeded by inadvertent highwall failure. <br />The operator was encouraged to temporarily buttress the slopes with pitrun to avoid this scenario. He stated that the operator <br />may seek to add more permitted acreage to adjoin the northern part of the permit, and seek release of reclaimed acreage on <br />the southern portion. Note: Adding acreage is by "permit amendment" (see Rules 1.8, 1.10 and 6.3). Instructions for <br />requesting release of permitted acreage are found in Rule 4.17. The Construction Materials Rules are found on the DRMS <br />website: www.mining.state.co.us. <br />The site was clean and orderly, with no contaminants or debris. The bond was estimated in 2004 and is currently $12,000. <br />The Division will recalculate the bond and inform the operator if a bond increase is indicated. <br />No further items were observed during the inspection.
