Access to l OH-C is west off Rio Blanco County Road 31 and <br />approximately 100 feet in length. This core-hole is in an area that is designated as Big Game Severe <br />Winter Range which is encumbered by a timing limitation for development activities from December 1 <br />to April 30. Discussion between the wildlife biologist from our office and in consultation with Colorado <br />Division of Wildlife (CDOW) biologists it is determined the timing limitation shall remain in effect <br />until Mayl, 2009. Therefore construction activities for IOH-C shall not occur until May 1, 2009. <br />As per the February 03, 2009 letter from BLM Colorado State Office to Natural Soda Inc., the current <br />BLM lease bond is required to be increased to $1,715,000. This bond is required to be in place prior to <br />beginning any construction activities of l OH-C. <br />The following are conditions of approval that apply to the construction activity involved with 10H-C. <br />Please note conditions number 1 (timing limitation) and 3 which requires a paleontological monitor. <br />1. Initial pad construction and well/cavity development should be conducted outside the big game <br />severe winter range period (i.e., outside the period of 1 January to 30 April). <br />2. The operator is responsible for informing all persons who are associated with the project <br />operations that they will be subject to prosecution for knowingly disturbing paleontological or <br />archaeological sites, or for collecting artifacts or fossils. If artifacts or fossil materials are <br />uncovered during any project or construction activities, the operator is to immediately stop <br />activities in the immediate area of the find that might further disturb such materials, and <br />immediately contact the authorized officer (AO).
