Cattany <br />, Division Director <br /> Natural Resource Trustee <br />RE: McClane Canyon Mine <br />Permit No. C-1980-004, Technical Revision No. 16 <br />Dear Mr. Ramatzke: <br />Thank you for your comments regarding the McClane Canyon Mine, Technical Revision No. 16. We <br />have completed a thorough review of the proposed waste pile and sediment pond construction project <br />proposed with Technical Revision (TR-16). The purpose of this letter is to let you know the status of <br />our review process and to summarize our findings. Based on comments received from you and your <br />staff at the DOW the monitoring station SW-1 has been relocated upstream (north) of the gully that <br />enters East Salt Creek a short distance upstream from the bridge (please note that the mine water <br />discharge point is located approximately 400 feet south of the bridge on East Salt Creek.) The mine <br />water discharge point is permitted by CDPHE through the Colorado Discharge Permit System (CDPS) <br />and is routinely monitored. Further, the planned coal mine waste disposal site will not add additional <br />mine water discharge stream to East Salt Creek; mine water discharge flows and quality will be <br />unaffected by the proposed waste disposal/sediment pond construction. The proposed sediment pond <br />will require a separate discharge point that will also be administered by the CDPHE through <br />modification of the existing CDPS permit. The sediment pond discharge is manually operated and is <br />designed to rarely discharge. We have also evaluated the potential hydrologic impacts of leachate <br />seepage from the waste pile and sediment pond bottom; and we have determined there will be <br />negligible impact to both alluvial groundwater and East Salt Creek. From our evaluation, potential <br />impacts to East Salt Creek from the proposed project would be insignificant. CAM Mining, LLC has <br />met all of our rules and requirements, and we are preparing to approve TR-16 in the near future. <br />We appreciate your input and if you or your staff would like to meet with us and/or the CDPHE Water <br />Quality Control Division we are happy to do that.
