<br />The Colorado Division of Rec-
<br />lamation, Mining and Safety pro-
<br />poses to Approve Permit Revi-
<br />sion Application No. 4, submitted
<br />by Snowcap Coal, Company, Inc..
<br />for a coal miningg'permitat the
<br />Roadside Portals (Permit No.
<br />C-1981.041). This revlslonappii-
<br />cation proposes a ppstmining
<br />land use change from "Fish and
<br />Wildlife Habitat" to "Industrial. or
<br />Commercial" for the Unit Train
<br />Loadout and associated facili-
<br />Iles including rail spur, rail loop,
<br />truck scale and haul road. Vari.
<br />ous aspects of the approved
<br />reclamation plan would be re-
<br />vised to accommodate the pro
<br />posal "Industrial or Commercial"
<br />land use, which would allow for
<br />continued use of the site for rail
<br />loading, uploadingg, and storage
<br />of construction me eriais.
<br />The Roadside Portals are to-
<br />cated In Mesa County, approxi-
<br />mately 5 miles north of Palisade,
<br />Colorado. Coal inter I est.is Fed-
<br />eral and private, and the sur-
<br />face to be affected Is Federal
<br />and private land. The permit
<br />area encompasses approxi-
<br />mately 3,016.00 acres.
<br />This proposed decision is based
<br />ona finding that the proposed
<br />operation will comply with all-re-
<br />quirements of•the Colorado Sur-
<br />face Coal Mining Reclamation
<br />Act, Section 34 33 101, at seq.,
<br />C.R.S., and the regulations pro-
<br />mulgated thereunder.
<br />Copies of the proposed deci-
<br />sion, including any stipulations,
<br />are on file for public inspection
<br />at the Colorado Division of
<br />Reclamation, Mining and Safety;

<br />terest that may be adversely af-
<br />fected by the proposed deci-
<br />sion may request a formal
<br />hearing before the Mined Land
<br />Reclamation Board on the pro-
<br />posed decision. Such request
<br />must be made within thirty (30)
<br />days of the Initial publication of
<br />this notice, must be in writing',,

<br />Being duly sworn, says that I am Leal Secretar_ of
<br />The Daily Sentinel a daily newspaper, published and duly printed in
<br />The County of Mesa, State of Colorado; that said newspaper has a
<br />general circulation in said County and has been continuously and
<br />uninterruptedly published therein, during a period of at least
<br />fifty-two consecutive weeks next prior to the first publication
<br />of the annexed notice; that said newspaper is a newspaper within the
<br />meaning of the act of the general Assembly of the State of Colorado,
<br />entitled "An Act to regulate the printing of legal notices and
<br />advertisements," and amendments thereto; that the notice of which
<br />the annexed is a printed copy taken from said newspaper, was published
<br />in said newspaper, and in the regular and entire issue of every number
<br />thereof, once a week for 2 successive weeks ;
<br />that said notice was so published in said newspaper proper and not in
<br />any supplement thereof, and that first publication of said notice as
<br />aforesaid, was on the 9th day of February , 2009,
<br />and the last, on the 16th day of Februarv. 2009.
