in the TR-62 application. This issue has been resolved, but the Division has comments
on retention of the shop, well, and road in the New Items section below.
2. The Division asked SCC to submit an amended Exhibit 7-1A to include the location of the W-25
series monitoring wells. SCC submitted the revised map; this issue is resolved.
3. The Division asked SCC to:
Confirm whether or not S-49 and "Friederich Spring #1" are the same feature -
SCC confirmed that S-49 and Friederich Spring #1 are one in the same; issue resolved.
Revise the apparently inaccurate statement on page 16-11 regarding the location of the
Friederich #1 and #2 springs -
SCC revised page 16-11 to accurately reflect the current information on the two springs; issue
resolved.
Confirm or amend the site location/drainage source for Friederich Spring #2 on Table 16-
1A and Exhibit 16-1 -
SCC revised Table 16-1A and Exhibit 16-1 to describe and depict the location/drainage source
for both springs; issue resolved.
Address how compliance with provision of Rule 4.05.15, Water Rights and Replacement,
has been (or will be) achieved with respect to the adjudicated spring (or springs)
impacted by mining on the Friederich property in the South Mine area.
SCC proposes to replace the flow from the two springs with water flowing into Pond 016. This is
acceptable for the remainder of the time the mine is permitted, but since it is not clear whether
SCC has rights to store water in Pond 016 on a permanent basis, and Pond 016 has not been
approved for permanent retention (SCC has not provided any of the required information for
retention of this pond), the proposed plan does not address water replacement on a permanent
basis. Prior to final bond release, SCC will need to obtain approval for permanent retention of
Pond 016 or propose an alternate replacement/augmentation plan for the water rights to the
springs. Please indicate whether SCC intends to address this concern along with the review of
TR-62, or would prefer that resolution of this item be addressed in a stipulation to our approval
of the revision.
Please update Attachment 16-A, "Water Rights Investigation and Plan for Augmentation" to
include a discussion of the Friederich springs.
4. The Division requested that SCC provide an additional Rill and Gully Survey addendum to
include the final geotechnical report and remedial plan for each of the Shrub Plot Slide and
Pond 016 Slide. SCC committed to submitting the required information. This response is
accepted. Please to commit to submitting the addendum within 60 days of the final report.
5. The Division noted that updates to the revegetation plan were warranted. The original
adequacy concerns from the Division were:
a. The woody plant density standard for aspen planting areas needs to be defined and
-2-
