the three remaining ponds, the road to the portal area, the backfilled portals, the backfilled bench
areas and the remaining highwall (although the highwall is a prelaw feature, it has remained stable
as well). In addition, the Division has not seen any subsidence-related problems at or around the
mine site.
Estimate of Continuing Safety, Health, or Environmental Problems
The Division believes, at this time, that the public health and safety concerns at the Twin Pines No.
2 Mine are minimized and have been reduced to the extent possible. As the reclamation at the site
gets "older", the vegetation will become even more established, further stabilizing the areas and
further limiting the potential for safety, health and environmental problems.
Proposed Reduced Inspection Frequency
Pursuant to Rule 5.02.2(8), the Division proposes to reduce the statutory inspection frequency of
the Twin Pines No. 2 Mine as set forth in Rule 5.02.2(1). The Division proposes to perform two
complete inspections at the site each year. The first inspection will be carried out in the spring
(March, April or May), in conjunction with the run-off period. The second inspection would be
carried out in the fall (September, October or November) after the summer thunderstorm period.
This concludes the Proposed Decision and Written Findings for Reduced Inspection Frequency for
the Twin Pines No. 2 Mine.
