<br />THIS DEED, Made this 7 day of December, 1973, be-
<br />tween NORA R. PARSONS, also known as NOP-4 PA98ONS;; of the
<br />County of Las Animas and State, of Colorado, of the first
<br />part"; and MCP ENTERPRISES; a Colorado limited partnership',
<br />of the County of Jelferson and State of Colorado, of the
<br />second part,
<br />WITNESSETH, That the said party of the first part; for
<br />and in consideration of One Dollar and other good, valuable
<br />and sufficient consideration to the said party of the first
<br />part in hand paid by the said party of the second part, the
<br />receipt whereof is hereby confessed and acknowledged; has
<br />remised, released, sold; conveyed and QUIT CLA3MED, and by
<br />these presents does retftse, release, sell, convey and QUIT
<br />CLAIM unto the said party of the second part, its succe"ssofs
<br />and "a"ssigns; forever, all the right, title, interest, claim
<br />and demand which the said patty of the first part has it and
<br />to all the minerals, including but not limited to, all oil,
<br />nAtUf6l and other gases, coal and otiher hydrocarbons, and
<br />all metallic and nonmetallic mineral ores and substancesj.
<br />on; in, and under, and that may be produced from; the fol-
<br />lowing described.lands situate, lying and being in the
<br />CoUnty of Las Animas and State of Colorado; to wit:
<br />Townships 32, 33 and 34 South,,' Ranges 66 and 67 West of
<br />the 6th Principal- Meridian, County of Las Animas and
<br />State of Colorado;
<br />Together with the free and uhlhtettupted right of way
<br />into, on, and under the above=describe,, lands at such
<br />points and -in such manner as may be proper and rsa=
<br />sonably necessary for the purpose of digging, miring,
<br />drilling, exploring, operating; and developing such
<br />land for such minerals, and producing, removing; storing,
<br />treating, handling, transporting, and Marketing the
<br />same therefrom, including but not limited to (a) the
<br />right to mine, drill, remove and transport such min=
<br />erals without liability for any injury that may result
<br />to the surface or to any overlying strata (whether from
<br />surface or subterranean mining and/or activities " e=
<br />lated thereto)., or to water courses or roads or ways by
<br />reason of the-Mining, removal and/or transportation of
<br />such minerals or of minerals under other-' lands; (b) the
<br />right to construct and use; and to authorize and cause
<br />any transportation or utility company to construct and
<br />USe, for one or more railroad and/6t pipeline rights of
<br />way (with incidental telephone and other utility lines),
<br />in and through any of the above-described lands *of the
<br />transportation of any such minerals produced iron t4idsc
<br />or other lands, and for the carriaab Of water; steam or
<br />other fuels or solvents used in mining, drilling or
<br />operating wells 'and/or mines or In the operation of
<br />pipelines; (c) the right to use such timber and. water
<br />from the above=described lands as riay reasonably be
<br />necessary for the developmomt, working; mining, dr 11-
<br />ing, removing, and treating of such ninerals and the
<br />preparation of such miher'als for market; and (d) the
<br />right to remove from the above-described lands all
<br />property and improvements placed thereon by the grantee,
<br />its successors and assigns.
