<br />NOTICE OF PROPOSED DECISION <br />The Colorado Division of Reclamation, Mining and Safety has accepted a request from New Elk Coal <br />Company LLC to withdraw Transfer of Permit Application No. 1 (SO-1), submitted by New Elk Coal <br />Company, LLC for the coal mining permit at the Lorencito Canyon Mine. The permit will not be <br />transferred and Lorencito Coal Company, LLC will remain the permittee. <br />The Lorencito Canyon Mine is a reclaimed surface mine located in Las Animas County, approximately 3 <br />miles west of Segundo on Hwy 12. The surface and the coal interest is private. The permit area <br />encompasses approximately 3,142.00 acres. <br />Copies of the proposed decision and the withdrawn application are on file for public inspection at the <br />Colorado Division of Reclamation, Mining and Safety, Room 215, Centennial Building, 1313 Sherman <br />Street, Denver, Colorado 80203 and at the County Clerk's Office in Las Animas County, 200 East First <br />Street, Room 104, Trinidad, CO 81082. Persons with an interest that may be adversely affected by the <br />proposed decision may request a formal hearing before the Mined Land Reclamation Board on the <br />proposed decision. Such request must be made on or before February 21, 2008, must be in writing, and <br />must state with reasonable specificity the reasons for the request and the objections to the proposed <br />decision.
