Cattany <br />Division Director <br />Natural Resource Trustee <br />r/ <br />Re: Breeze Basin Sand and Gravel Pit, ll2c permit Application No. M-2008-022, Army Corp of <br />Engineer Issues. <br />Dear Mr. and Mrs. Brennise, <br />On July 24, 2008 the Division of Reclamation Mining and Safety (DBMS) approved the above <br />referenced permit application. As part of the approval letter it was noted: "Please note that no <br />disturbance may begin until all other applicable federal, state and local permits have been issued. Any <br />changes required by the Army Corp of Engineers should be forlvarded to the Divisio~z for review and <br />may require a Technical Revision to approved permit plans. " <br />On~February 6, 2009 the Division received a copy of correspondence that indicates that the Corp notes: <br />" we do not believe that it will be possible for you to avoid any and all discharges of dredged or fill <br />material within waters....". This letter is a reminder to the operator that any changes required to meet <br />the Corp of Engineer's requirements will be needed to be submitted as a Technical Revision to the <br />mining and reclamation plans for DBMS staff review and approvals.
