(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1977-140 <br />INSPECTION DATE 1/28/09 INSPECTOR'S INITIALS RCO <br />OBSERVATIONS <br />This inspection was performed by the Division as part of its monitoring of Construction Materials 112c permits. The operator <br />was contacted about the scheduled inspection. The operator's representative named on page one was present during the <br />inspection. The site was not active at the time of the inspection. <br />The required permit ID sign and boundary markers were observed during the inspection. The future lake area that was <br />approved under amendment AM-1 has not been affected by mining operations, but its boundary corners were marked. A new <br />residence has been constructed close to the NW corner of the existing lake (on a subdivided lot zoned for such use). <br />The lake was frozen, and the level was high enough that all portions of the floor were covered. The banks around the lake are <br />gently sloped and mainly exhibit pitrun cobbles on the surface. The existing approved reclamation plan requires pond slopes <br />that are 5:1, with topsoil to be replaced and seeding to occur. No topsoil stockpile was evident onsite, and the revegetation <br />currently consists of willow thickets and cottonwood seedlings, all along the water line. There was very little grass on the <br />banks. <br />The operator stated that he is interested in finishing the reclamation for the lake and banks and getting that portion of the permit <br />released. The operator should first review the approved reclamation plan to see what grading, topsoil replacement and seeding <br />must be performed. If the areas to be considered for release do not meet the reclamation plan they should be further <br />reclaimed. If those areas do not meet the approved reclamation plan but can be demonstrated to be stable with no further <br />reclamation, the reclamation plan should be revised through a technical revision. <br />The operator is not mining from this lake, but has been mining from the permitted pit immediately adjacent to this one (M-2000- <br />110) and processing the material in his own plant. There is a large stockpile of pitrun to be processed on this site, that was <br />excavated from the neighboring pit prior to winter, and excavation has ceased. There is an elevated diesel tank on this site <br />near the location where the adjoining pit is accessed. There is no impermeable secondary liner under it, which would normally <br />be noted as a problem, but the operator stated that the tank was empty presently. Prior to start-up of operations this spring, the <br />operator must ensure that this tank and all tanks, as well as all other fluid storage locations, are afforded impermeable <br />secondary containment. <br />The bond amount is currently $36,355. The last bond recalculation was on 12/5/05 and reflected that several concrete <br />structures had been removed, though those cost savings were offset by increased unit costs, resulting in no net change. If the <br />operator wishes to reduce the acreage or the bond for this permit, it should be confirmed that the approved reclamation plan <br />has been followed and reported to this office. We will recalculate the bond, based on the reported and observed condition of <br />the site and the existing reclamation plan. If the new figures indicate an increased bond, the operator must provide it within 60 <br />days of notification. <br />The site was orderly, with no noxious weeds or debris. There was some old equipment south of the plant, which may be <br />counted in the bonded reclamation liability. <br />No further items were observed during the inspection.
