EXIFCA
1%5 Cos/Cvmpuny Seneca Coal Company
January 7, 2008
RECEIVED
Mr. Mike Boulay o
Division of Reclamation, Mining and Safety JAN 0 U 2005
101 South 3fd, Suite 301 ,,,amationv
g and Safety
Grand Junction, CO 81501 Mining
(970) 242-5025 Mi
RE: Yoast Mine, Permit No. C-1994-082
Technical Revision No. 36 (TR-36) - Sediment Pond 012A Design
Adequacy Response
Mr. Boulay,
Seneca Coal Company (SCC) has reviewed the Adequacy Comment letter dated October 25, 2007 and offers
the following responses and updated information. Enclosed are two (2) copies package, while a third copy of
this package has been sent to the Denver office also addressed to you.
1. On Exhibit 12-1, two ligbt-use roads are shown one in the North Pit and anotherfrom the Neck Pit Area According to
the Backfill and Grading Plan, Exhibit 19-1A the light-use roads have been backfilled and graded as of August 1, 2007.
Please update these exhibits accordingly so that they ate consistent and accurate.
Also shown on Exhibit 12-1 are Haul Road B and the haul/access roach into the Yoast South area to the Wolf Creek
and Wadge Mined Seams and the Scraper Pit areas. According to the Backfll and Grading Plan, Exhibit 19-1A, Haul
Road B and the haul/ access roads to Yoast South area are scheduled to be backfilled andgraded by 2008.
SCC has recently submitted a Phase I Bond Release Request for the Yoast Mine and in this application the Haul Road B
and haul/ access roads into the Yoast South area have been excluded from the release request. It seems that at least some
access to the Yoast Mine will be necessary for monitoring, sediment pond inspections, and possibly post mine land uses.
Roads are discussed in Tab 13 of the permit application package (PAP), but SCC has not specificaly designated these
roads or any other roads as permanent. Does SCC have plans to designate any roads as permanent? If
so, then SCC should request permanent retention of these road(s) and update the PAP
accordingly to demonstrate compliance with Rules 2.05.5(1) (b) and 4.03.
Response: Exhibit 12-1, Operations Plan, has been revised to address your comments. Please replace the
existing Exhibit 12-1.
In response to the question regarding permanent roads - yes, SCC will request some roads to be left
permanent. A technical revision is being developed for submittal regarding permanent facilities.
If you have questions, please contact me.
Sincerel
Roy Karo
Reclamation Manager
Seneca Coal Company a P.O.
