Enclosed are two (2) copies package, while a third copy of <br />this package has been sent to the Denver office also addressed to you. <br />1. On Exhibit 12-1, two ligbt-use roads are shown one in the North Pit and anotherfrom the Neck Pit Area According to <br />the Backfill and Grading Plan, Exhibit 19-1A the light-use roads have been backfilled and graded as of August 1, 2007. <br />Please update these exhibits accordingly so that they ate consistent and accurate. <br />Also shown on Exhibit 12-1 are Haul Road B and the haul/access roach into the Yoast South area to the Wolf Creek <br />and Wadge Mined Seams and the Scraper Pit areas. According to the Backfll and Grading Plan, Exhibit 19-1A, Haul <br />Road B and the haul/ access roads to Yoast South area are scheduled to be backfilled andgraded by 2008. <br />SCC has recently submitted a Phase I Bond Release Request for the Yoast Mine and in this application the Haul Road B <br />and haul/ access roads into the Yoast South area have been excluded from the release request. It seems that at least some <br />access to the Yoast Mine will be necessary for monitoring, sediment pond inspections, and possibly post mine land uses. <br />Roads are discussed in Tab 13 of the permit application package (PAP), but SCC has not specificaly designated these <br />roads or any other roads as permanent. Does SCC have plans to designate any roads as permanent? If <br />so, then SCC should request permanent retention of these road(s) and update the PAP <br />accordingly to demonstrate compliance with Rules 2.05.5(1) (b) and 4.03. <br />Response: Exhibit 12-1, Operations Plan, has been revised to address your comments. Please replace the <br />existing Exhibit 12-1. <br />In response to the question regarding permanent roads - yes, SCC will request some roads to be left <br />permanent.
