Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, <br />Section 116, Paragraph 4, of the Colorado Revised Statutes, that on April 4, 2008, an application to revise coal <br />mining operations at the Yoast Mine was considered complete for the purposes of filing. The revision was <br />submitted by Seneca Coal Company. All review and comment periods as provided in the Act and the Regulations <br />initiate from this date of filing. <br />This revision application provides updated legal information including surface and mineral ownership and <br />easements, owners & controller information, and compliance information for Seneca Coal Company. In addition, <br />the application contains designs for new permanent stream channels, revised sedimentation modeling, and request <br />for retention of certain facilities (roads, ponds, exclosure fencing, etc.). <br />The revision does not entail any additional surface disturbance, nor does it alter previously approved <br />wildlife mitigation measures. Aspects of the revision application that may be of interest to CDOW include <br />requests for retention of certain existing structures (including certain ponds, roads, and elk fencing associated with <br />shrub and tree planting areas). The request for retention of permanent facilities is contained in Attachment 20-1 of <br />the revision application. <br />The surface coal mining operation is on land located approximately 7 miles Southwest of Hayden, Colorado. The <br />permit area is further described as follows: <br />T6N, R87W, Portions of Sections 28, 29 and 32 <br />T5N, R87W, All of Section 17; Portions of Sections 5, 8, 16, 18, 19, 20, 29, 30 <br />Mt.
