The TR as submitted <br />includes and is limited to: the addition of Cross Mine (DRMS permit M1977-410) <br />material to the source materials for the Gold Hill Mill. In support of the TR, MRV offers <br />the following: <br />1) Per the Mineral Rules and Regulations of the Colorado Mined Land Reclamation <br />Board for Hardrock, Metal and Designated Mining Operations, (MLRB Rules) <br />Rule 1: General Provisions and Requirements, 1.1 Definitions, (12) (1.1.12 - <br />"Custom Mill"), "Custom Mill is a mill that is not engaged in the processing of <br />ore from any permitted mine that is owned or under common control with the <br />milling facility or the entity operating the milling facility" [emphasis added]. The <br />Gold Hill Mill (DRMS permit M-1994-117) is engaged in the processing of ore <br />from the Cash & Who Do Mines (DRMS permit M-1983-141) which are under <br />common control with the milling facility. By this definition, the Gold Hill Mill is <br />not a custom mill. <br />2) As part of the mining and milling process at MRV's permitted operations (M- <br />1994-117, M-1983-141), MRV utilizes an EPA-UIC Class V permitted tailings <br />backfill. The addition of additional materials from the Cross Mine to the Gold <br />Hill Mill process stream will greatly benefit the mining method by increasing the <br />backfill material available. The addition of Cross material will be a beneficial <br />accessory use of the mining and milling currently permitted and active at the <br />MRV site.
