ORIGINAL - PUBLIC FILE <br />(Page 2) <br />MINE ID # OR PROSPECTING ID #: m-i 99n-ntb -- <br />INSPECTION DATE: 11491 inR $ 9491n9 INSPECTOROS INITIALS: RK-- <br />OBSERVATIONS <br />The Division conducted a monitoring inspection of the site as part of sites to be <br />inspected during the fiscal years 2008 and 2009. <br />1) Site is a small 110 9.9 acre moss rock harvesting operation located along the NORTH <br />Side of South Table Mountain Quarry, in Fremont County. The Board approved permit of 1992 <br />after the operator was found in violation of mining with out a permit only allows him /or <br />her to only remove moss rock utilizing a rubber tired equipment from the approved permit <br />area. No processing of any kind is approved on site under the Board approved permit. The <br />area affected by the operator at that time included both the Federal and State lands. <br />2) In May, 1996 under SR-001, the operator removed all the Federal land from the permit. <br />3) Operator was contacted about the pending inspection, but was unable to attend. However, <br />Mr. Mike Zulke, who works at the site was present at the time of the inspection. He stated <br />that he was just trying to star one of the two front end loaders on site. There were two <br />front end loaders and a flat bed trailer noted with small amount of stockpiled moss rock <br />and old tires along the SW side of the area. <br />4) According to the annual report the total affected area is stated to be .3 acres. When <br />the Division tried to contact Mr. Wagner at the contact telephone #, Mrs. Wagner stated <br />and later confirmed by Mr. Wagner when contacted using his cell phone, provided by Mrs. <br />Wagner that Mr. Wagner is no longer owner of High Plain Stone CO. However, Mr. Wagner <br />stated that, even though he is no longer the owner of High Plains Stone co, he still is <br />the owner of the site. Since both Mr. and Dirs. Wagner are listed as the permit holder for <br />the site, at this time DRMS does not see the need to transfer the permit to Mrs. Wagner. <br />All the Division wants is to make sure that the permit is in compliance with the MLRD <br />BOARD approved reclamation plan. <br />5) Because the expected disturbance only allows the operator to remove moss rock utilizing <br />rubber tired vehicles, the Board determined the warranty to be only $2,000.00. <br />6) On 11/6/1997, after a site inspection, operator was site for a possible violation for <br />not placing adequate permit boundary markers which were resolved in 2001, but were entered <br />in the data base as resolved in 2004. <br />7) The Division understand keeping signs and markers in such a terrain is difficult at <br />best, however, it is very important for the operator to make sue whom ever is operating <br />under the permit is full cognizant of the permit area, to avoid being in violation of the <br />approved permit boundary. It is also important to include a amp in the annual report <br />rather than saying the "map on file correctly depicts current acreage. The annual report <br />not only must show current working area, it also has to show any changes from year to year <br />taking place on site. Please include a map with the annual report. <br />8) At present the operation appears to be in compliance with the BOARD approved <br />reclamation plan.
