ORIGINAL - PUBLIC FILE <br />(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-1979-199 <br />INSPECTION DATE: )pig $ 9/9/n9 INSPECTORS INITIALS: RK <br />OBSERVATIONS <br />The Division conducted a monitoring inspection of the site as part of sites to be <br />inspected during the fiscal years 2008-2009. Present during the inspection on both days <br />was Mr. Joe Gagliano, the operator's consultant. <br />1) Site is a phased 112 construction materials operation located 6 miles North of Penrose, <br />Colorado. <br />2) Total permitted acres 53.91 of which 43 acres are planned to be affected through out <br />the life of the mine. The maximum affected acres at any given time is 9.9 acres. Post <br />mining land use is wild life habitat <br />3) Site was converted from a 110 to a 112 on May 8, 2000. <br />4) The was transferred on 4/25/08 from Colorado Piet Lien and sons to Rock bottom LLC. <br />5) When site was inspected on 10/6/08, the only activity on site was the construction of a <br />new scale. There was some already processed screened material along the North east side of <br />the permit area-. <br />6) Pit area covers approximately 2 acres with a high wall approximately 8-12 feet deep <br />extending 200 feet North to South. High wall stable. Some Tamarisk noted in the pit area. <br />Operator has a noxious weed control plan in place, and plans to actively remove the <br />tamarisk, which was no more than noted outside the permit area. <br />7) Entire permit area inspected, top soil piles along the west side of the permit area <br />were stable. <br />8) When site was inspected on 2/2/9 the scale house and scale are completed. Not active, <br />at the time. More processed material was noted than was observed in October. The Screen, <br />front end loader, and trucks were noted parked along the south side of the permit area. <br />8) The current financial warranty in the amount of $45,978.00 is more than adequate to <br />cover the cost of the present disturbance.
