111. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This partial inspection of the King Coal 1 Mine was conducted by DRMS staff from the Durango Office, <br /> located at 691 County Road 233, Suite A 2, Durango, CO 81301, phone (970) 247-5469. Operations <br /> were active. Five highway haul trucks were stopped at the mine entrance, awaiting entry to the yard <br /> area for loading. Mine identification sign and permit boundary markers were posted. <br /> The drainage swale in the entrance road, which directs yard drainage to the east sediment pond, was <br /> intact. The safety berm around the east pond, with culvert inlet to the east pond, was intact. <br /> Significant earthen material appeared to have been recently added to the safety berms for the east <br /> and west sediment ponds. <br /> The east and west sediment ponds were holding water, visually estimated at one foot depth and well <br /> below discharge levels; no discharge was observed from either pond. The primary and secondary <br /> spillways for the east pond were clear and functional, as were the primary spillway for the west pond <br /> and the overflow pipe from the west pond to the east pond. The secondary spillway for the west pond <br /> was affected by recent sediment clean-out and needs to be re-established to the configuration <br /> approved in permit documents. <br /> Evidence of affected area drainage escaping the permit area was not observed. The site appeared <br /> stable and well-maintained. <br />
