III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This partial inspection of the Carbon Junction Coal Mine was conducted by DRMS staff from the <br /> Durango Office at 691 County Road 233, Suite A-2; Durango, CO 81301, phone (970) 247-5469. <br /> Four photos accompany this report. <br /> Public access to the permit area is controlled by a locked gate at the mine entrance. Previously, <br /> unknown individuals have driven four-wheel drive vehicles around the locked gate. Barriers, <br /> composed of large boulders and/or ditches and earthen berms, were constructed beside the north and <br /> south sides of the entrance road at the gate to discourage unauthorized access to the permit area. <br /> However, unknown individuals continued to drive around the north barrier. As shown in the photo, the <br /> north barrier has been extended, again, to discourage unauthorized access to the site. No individuals <br /> were contacted and no activities were observed during the inspection. <br /> Sediment Pond 1, previously located at the southwest comer of the permit has been backfilled. <br /> Topsoil Stockpile 8, previously located immediately adjacent to the west side of the pond has been <br /> removed. The west face of Topsoil Stockpile 4, located adjacent to the east side of the pond, <br /> appeared to have been recently disturbed, possibly due to removal of material. The area previously <br /> containing Sediment Pond 1 and Topsoil Stockpile 8 has been graded to conform with the topography <br /> of the adjacent agricultural field. One portable toilet was located nearby the previous location of <br /> Sediment Pond 1. <br /> The embankment for Sediment Pond 2, located at the\Rest side of the permit area, has been <br /> removed. Earthen material from the removed embankment had been distributed at the base of the <br /> steep slopes immediately north of the pond. <br /> Drainage was impounded in a section of the East Collection Channel immediately upstream of the <br /> triple culverts for the road crossing providing access to the Mutual Use Area (MUA). Due to snow <br /> cover the status of the triple culverts could not be determined. <br /> The North Pit area was not inspected. <br />
