Cattany <br />Division Director <br />Natural Resource Trustee <br />Re: Foidel Creek Mine, C-82-056, Fourth Quarter 2008 Coal Waste Pile Inspection Report <br />Dear Mr. Nettleton: <br />The Division received Twentymile Coal Company's (TCC) Fourth Quarter 2008 Coal Waste Pile Inspection <br />Report on February 9, 2009 via e-mail. The report was prepared by North West Colorado Consultants for <br />Twentymile Coal Company. Compaction tests were conducted on. November 7, 2008 at locations 396 <br />through 401 Areas 2 through 3 1/2 of the refuse disposal area (RDA). No problems were noted in the <br />engineer's report with regard to the construction, grading, drainage, or operation of the pile. The Engineer <br />visited the site on December 29, 2008. Based upon TCC's reported throughput of coal through the wash <br />plant, the engineer estimates 244,700 to 275,280 tons of coal refuse was added to the RDA during fourth <br />quarter 2008. The report also noted that TCC is placing cover material at the Northeast corner of Area 1. No <br />maps or sketches of the refuse area or hole locations were provided with this report. <br />North West Colorado Consultants, Inc. conducted the inspection and provided their results to TCC. Results <br />of monitoring of 5 piezometers was included in the report. Water levels reported for 4 of the 5 piezometers <br />remain consistent with previously reported trends. The N piezometers water leveation continues to measure a <br />steady drop in water elevation. No further explanation for this water level drop was provided in the report. <br />TCC provided Nuclear Density Test results in the report as well.
