Mathews <br />Environmental Protection Specialist <br />Division of Reclamation, Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />FEB -1 1 2688 <br />Division of ktL;,-...uon, <br />Mining and Safety <br />Re: McClane Canyon Mine (Permit No. C-1980-004) Technical Revision Application No. 16 (TR-16): <br />Coal Mine Waste Disposal Site Plan (CHS #51715) <br />Dear Mr. Mathews: <br />Thank you for your correspondence dated January 3, 2008 (received by our office on January 10) concerning the <br />technical revision to the coal mine permit listed above for construction of a coal mine waste disposal site located <br />within the NW 1/4 of SW'/4 of Section 21 (T 7S 11102W) in Garfield County. <br />Based on the information provided, a search of the Colorado Cultural Resource Inventory indicated that site <br />5GF741 has been recorded in the vicinity of this area proposed for additional disturbance. On August 27, 1982 <br />site 5GF741 was determined to be potentially eligible for the National Register of Historic Places (NRHP). This <br />information has previously been conveyed to your office in a letter from the Colorado Historical Society dated <br />November 7, 1996. Please note that our previous correspondence regarding Permit Renewal 6 (RN-6) dated <br />December 5, 2005 erroneously stated that this site had been determined not eligible for the NRHP. <br />Consequently, we recommend that the proposed activities avoid site 5GF741. If site avoidance is not possible, <br />we recommend further consultation with our office in order to identify options to avoid, minimize, or mitigate <br />adverse effects to the site. <br />Please note that our review of your project is expedited when you indicate the extent of the proposed permit <br />area on a legible portion of the appropriate and clearly identified 7.5 minute USGS topographic map. <br />Thank you for the opportunity to comment.
