C-1981-022 <br />RN-05 Findings <br />February 2009 <br />• TR-61, approved September 23, 2008, added one Mine Vent Borehole, pad and associated light <br />use road. <br />Eighteen Minor Revisions (MRs) <br />• MR-70, approved November 3, 2003, allowed OMLLC to conduct testing of emissions from <br />previously installed Sanborn Mine Methane De-gas Wells. <br />• MR-71, approved December 3, 2003, provided for the construction of two topsoil stockpile areas <br />during construction of the II West Coal Refuse Facility roads and sediment pond. <br />• MR-72, approved June 2, 2004, updated Air Emissions and Water Discharge permits. <br />• MR-73, approved July 12, 2004, provided for the drilling of two coal exploration holes at the <br />location of the reclaimed Blue Ribbon Mine. <br />• MR-74, approved July 13, 2004, expanded the facilities for the Somerset Water District. <br />• MR-75, approved March 11, 2005, provided for surface preparation at the Hubbard Creek <br />Fansite. <br />• MR-76, approved March 21, 2006, added as-built information for the mine water transfer <br />borehole at the Hubbard Creek Fansite and an amended CDPS Permit for abatement of NOV# <br />CV-2006-001. <br />• MR-77, approved March 27, 2006, updated the Weed Control Plan. <br />• MR-78, approved June 9. 2006, incorporated various modifications to mine facilities. <br />• MR-79, approved June 9, 2006, addressed Mid-Term Review items, including the addition of a <br />Biological Block Clearance and Cultural Resources Inventory. <br />• MR-80, approved June 9, 2006, provided expedited approval for two of the TR-54 Methane Vent <br />Boreholes due to elevated methane levels in the mine. <br />• MR-81, approved July 20, 2006, expanded the size of the Warehouse Facility. <br />• MR-82, approved July 20, 2006, extended a light use road east of the Hubbard Creek drainage. <br />• MR-83, approved September 20, 2006, incorporated seed mixes required by the BLM and USFS. <br />• MR-84, approved September 7, 2007, provided for the relocation of a previously approved <br />Methane Vent Borehole. <br />• MR-85, approved October 29, 2007, provided for the installation of a methane exhauster pump <br />apparatus at the Hubbard Creek Fansite and replacement of the BC-1 alluvial well which had <br />been damaged. <br />• MR-86, approved May 2, 2008, provided for the relocation of a previously approved Methane <br />Vent Borehole. <br />• MR-87, approved November 13, 2008, added a utility borehole to the Methane Vent Borehole <br />pad permitted under TR-61. <br />As the mine has been in operation since 1902, much of the disturbed area associated with the mine <br />was affected prior to the effective date of the Surface Mining Control and Reclamation Act of 1977 <br />and the Colorado Surface Coal Mining Reclamation Act. Baseline environmental factors were not <br />measured, and no topsoil was salvaged prior to previous disturbance. Disturbances which have been <br />conducted since the effective date of the Act have been permitted and conducted in compliance with <br />12
