Cattany <br />Foidel Creek Mine Division Director <br />29515 Routt County Road No. 27 Natural Resource Trustee <br />Oak Creek, CO 80467 <br />RE: Third and Fourth Quarter 2008 Discharge Monitoring Report, COG-850048 <br />Dear Mr. Watterson: <br />Twentymile Coal Company (TCC) submitted NPDES Discharge Monitoring Reports (DMR), for CPDS <br />permit COG-850048 on October 30, 2008, Colorado, and February 2, 2009, for third quarter 2008 and <br />fourth quarter 2008 respectively. CPDS permit COG-850048 was issued to TCC for emergency mine <br />water discharge from the l ORT borehole (one outfall 001A/001 W) in order to comply with MSHA <br />direction. COG-85-0048 was issued 8/28/2008, so the third quarter report covers 8/28/2008 through <br />9/30/2008. <br />TCC measured parameter exceedances for total recoverable Iron for both third and fourth quarter 2008. <br />These exceedances were reported to CDPH&E. TCC reported that they are coordinating with consultants <br />for a treatment method for this location. <br />WET testing for third and fourth quarters 2008 were toxic to Cerodaphnia. Accelerated WET tests were <br />conducted during fourth quarter 2008 with Ceriodaphnia toxicities continuing during the fourth quarter as <br />well. WET tests conducted using water collected further downstream than at the outfall were able to pass. <br />TCC is communicating with CDPH&E regarding methods to address WET test concerns. TCC will <br />continue to work on treatment solutions for this discharge. <br />The report is in compliance with Rule 4.15.13(2)(iii).
