Cattany Division Director Natural Resource Trustee The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, Section 116, Paragraph 4, of the Colorado Revised Statutes, that on February 9, 2009, an application to revise coal mining operations at the Trapper Mine was considered complete for the purposes of filing. The revision was submitted by Trapper Mining, Inc.. All review and comment periods as provided in the Act and the Regulations initiate from this date of filing. Trapper has provided updated mine plan for the 5-year permit term, 2008-2012. This plan includes East Ashmore, Flintlock, East Ashmore, (Z), Gatling, and the new Kimber Pits. Ash disposal will continue in the Ash disposal pit. Two fills are proposed, Horses fill and Buttress fill. An additional 312 acres of new disturbance is proposed within the current permit area. The surface coal mining operation is on land located approximately 6 miles Southwest of Craig, Colorado. The permit area is further described as follows: Portions of Sections 1, 2, and 3, Township 5 North, Range 91 West of the 6th P.M. Portions of Sections 30 and 31, Township 6th North, Range 90 West of the 6th P.M. Portions of Sections 25, 26, 28, 33, 34, 35, and 36, Township 6 North, Range 91 West of the 6th P.M. The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Castor Gulch. Because the above-referenced permit revision application would incorporate additional lands into the permit area or might otherwise alter previously approved permit conditions or mitigation measures, we are requesting your agency's evaluation of the potential for impacts to cultural and historic resources. In accordance with the May 1991 Memorandum of Understanding (MOU) between our agencies, we must have your concurrence in order to approve this proposal. We are required to make a fording that "the proposed operations will not adversely affect any publicly owned park or place listed on or those places eligible for listing, as determined by the SHPO, on the National Register of Historic Places, unless approved jointly by the Board and the Federal, State, or Office of Office of Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
