Ill. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the operator <br /> during the field inspection. The site was partially covered in snow. <br /> Hydrology <br /> There was only a little snow in the west side dugout sediment pond. The single open channel spillway had <br /> sufficient capacity. There was only a little ice-covered water in the east side sediment pond.The gated primary <br /> valve was closed.The pond embankment and pond inslopes were stable. The emergency spillway had enough <br /> capacity. <br /> The straw bales and silt fence were in position along the railroad track small area exemption. There was no <br /> water in the private diversion ditch.Most of the culverts and ditches were snow covered. <br /> Roads <br /> The paved haul road was free of snow and was in good condition.The guard rail was up. There was some sand <br /> on the road that had been used for traction but the sand was not being tracked onto the highway. The graveled <br /> east entrance road was in good condition as well.The east gate was open.The light use road along the railroad <br /> tracks was snow covered but was passable. <br /> Sims and Markers <br /> There were three mine ID signs at the loadout.One was at the main entrance.The other two were at the east <br /> entrance and near the railroad tracks. <br /> Topsoil <br /> The topsoil stockpile on the east side of the loadout was covered in snow.The topsoil sign was up.The <br /> collection and diversion ditches associated with the topsoil stockpile were also covered in snow. The west side <br /> topsoil stockpile was partially covered in snow.The topsoil sign was up on this stockpile as well. <br /> Facilities <br /> There was very little stockpiled coal on site.There were no coal haul trucks unloading and no rail cars being <br /> loaded during the inspection. There were only four rail cars on site.There were no indications of fugitive dust <br /> going offsite. There were no leaks at the fuel facility.No problems were observed at the loadout office, <br /> substation,material storage area or coal processing and loading structures. <br /> c 1word/terror/insp0209 <br />
