III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> There was no activity on coal waste pile no. I or on coal waste pile no.4. On the east end of coal waste pile no. <br /> 2,the operator was spreading coal waste over the pile.Additional coal waste was being dumped by truck onto <br /> the central portion of coal waste pile no.2.The coal waste piles had positive drainage and there were no <br /> indications of erosional problems on the outslopes.There was no evidence of slope instability with the piles. <br /> The upland diversion ditch was in place.No problems were noted with the coverfill stockpile as well. Surface <br /> disturbance markers were up around the disturbed area. There was no activity at the coal waste pile no. 3 <br /> construction site. <br /> The culverts and ditches in this area were functioning properly.Pond F had a little ice-covered water in it.The <br /> pond had been recently pumped out due to snowmelt.The discharge pipeline had apparently froze so the <br /> operator used a fire hose to discharge the pond water. <br /> Unit Train Loadout <br /> There were no unit train railcars on site.Due to the reduced mining tonnage,Bowie has reduced rail shipments. <br /> Bowie has shipped out two unit trains of washed West Elk coal.The sediment control system at the loadout was <br /> in place.Culverts and ditches were functional. Ponds J and K had only snow in them. The mine ID sign was up <br /> at the entrance and surface disturbance markers were up around the disturbed area.The topsoil stockpiles were <br /> covered in snow. <br /> The outslopes of the spur line bench were stable. There was no water coming out of the railroad culverts or <br /> underdrains on the west side of the spur line bench.No problems were noted on the east side of the spur line. <br /> Hubbard Creek Area <br /> The underground development mining of the B seam has connected with the Hubbard Creek vent shaft.A <br /> contractor was preparing to install the power line and the communications line down the shaft.The D-seam <br /> dewatering pipe was also going to be installed down the vent shaft so that water from the D-seam can be <br /> pumped from the D-seam water pump station down the vent shaft into the B-seam workings and,then,to the <br /> river by means of the discharge pipeline. <br /> The upland diversion ditch at the shaft site was covered in snow. Straw bales were placed across the shaft site <br /> road for sediment control. Silt fence was also in place next to the Hubbard Creek road.When the snow melts, <br /> the silt fence will need some repair. Surface disturbance markers were up around the disturbed area and mine ID <br /> signs were up. The mud pit was covered in snow and will be reclaimed in the spring. <br /> Further up the Hubbard Creek road,the D-seam dewatering station pad had been recently graveled and straw <br /> bales were in place across the pad road.The topsoil stockpile was covered in snow. The excess rock at the <br /> intersection of the Hubbard Creek road and Freeman Gulch road was covered in snow. <br /> Records <br /> The mine records were at the mine office and were up to date.Please refer to the attached records checklist. <br /> c:/word/bowie2/insp0209 <br /> 2 <br />
