III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the inspection
and the facts or evidence supporting the enforcement action.
This was a partial inspection conducted by Kent Gorham of the Colorado Division of
Reclamation, Mining, and Safety (Division). This mine site is currently completing the final
stages of reclamation of disturbed areas. Ground conditions were generally dry and the
weather was sunny and cool.
Roads
Roads released under an industrial land use (coal bed methane extraction) have been
recently re-surfaced with gravel. Some sections of the permanent road within the disturbed
area also benefited from this maintenance activity. The culvert on the road leading to pond 9
has been replaced.
Hydrologic Balance
The weir box remains at the former service area for installation at Pond 5 when ground
conditions allow and equipment is available.
General Mine Plan Compliance
Gully repair is complete at three locations in reclamation parcels W-2 and C-2 (Annual
Reclamation Report maps). Areas have been repaired and re-seeded as shown below.
Additional work remains on ditches and downdrains when equipment is mobilized from the
New Elk Mine. One area needing work is the ditch diverting runoff from Area W-6 to the
west downdrain to fill 8, below the culvert on the road to pond 8. Re-shaping and repair is
required.
