III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of <br />Reclamation, Mining, and Safety (Division). This mine site is currently completing the final <br />stages of reclamation of disturbed areas. Ground conditions were generally dry and the <br />weather was sunny and cool. <br />Roads <br />Roads released under an industrial land use (coal bed methane extraction) have been <br />recently re-surfaced with gravel. Some sections of the permanent road within the disturbed <br />area also benefited from this maintenance activity. The culvert on the road leading to pond 9 <br />has been replaced. <br />Hydrologic Balance <br />The weir box remains at the former service area for installation at Pond 5 when ground <br />conditions allow and equipment is available. <br />General Mine Plan Compliance <br />Gully repair is complete at three locations in reclamation parcels W-2 and C-2 (Annual <br />Reclamation Report maps). Areas have been repaired and re-seeded as shown below. <br />Additional work remains on ditches and downdrains when equipment is mobilized from the <br />New Elk Mine. One area needing work is the ditch diverting runoff from Area W-6 to the <br />west downdrain to fill 8, below the culvert on the road to pond 8. Re-shaping and repair is <br />required.
