Since you have <br />indicated restarting your operations in July, BLM will extend your approved plan of operations <br />until August 2, 2014 (initially approved August 2, 2002). Pursuant to 43 CFR 3809.424 (a), if <br />you stop conducting operations for any period of time after July 2009 that differ from your <br />approved plan of operation, you must submit a modification to your interim management plan to <br />BLM according to 43 CFR 3809.424 (a) (1) (1). <br />Recent inspections of your operation have not identified any significant unnecessary or undue <br />degradation of public lands; however, the following items must be addressed as soon as possible <br />when access to the mine can be accomplished: <br />1. Removal of "Private Property - No Trespassing" sign from public lands. <br />2. Installation of a secure locked closure at the portal. Currently there is none as the old <br />collapsed portal closure has been removed. <br />3. Repair of damaged barricade installed at BLM closure to prevent access across Henson <br />Creek; this closed route was accessed by your equipment when the collapsed portal was <br />cleared. Access to the Ophir Mine by vehicle or other equipment is limited to the access <br />route in the approved plan of operation. <br />1
