Application Form <br />2. The Certification Page has not been filled out completely. Please submit a <br />replacement page and include a corporate seal. If there is no corporate seal, than <br />either write "no seal" or draw a seal. In addition, the Company Name does not match <br />the name that is registered with the Secretary of State's (SOS) office. Please list the <br />Company Name exactly as it is registered with the SOS. <br />6.4.1 Exhibit A - Legal Description and Location Map <br />No comment. <br />6.4.2 Exhibit B - Index Map <br />No comment. <br />6.4.3 Exhibit C - Pre-mining and Mining Plan Map(s) of Affected Lands <br />3. The Mining Plan Map does not include the type of present vegetation covering the <br />land. Please include this information as required by Rule 6.4.3(e). <br />4. Rule 6.4.3(g) requires the applicant to identify the owners of any significant, <br />valuable, and permanent man-made structures within two hundred feet of the affected <br />land. Please provide the owner's name with any associated structures on the Mining <br />Plan Map. <br />5. The applicant has indicated in Exhibit G that ditches/ponds may be constructed to <br />recharge groundwater. Please indicate on the Mining Plan Map where these structures <br />would be constructed. <br />6. The Mining Plan states that the operator does not anticipate stockpiling bedrock <br />material. Please indicate on the Mining Plan Map where bedrock material would be <br />stockpiled if necessary. <br />6.4.4 Exhibit D - Mining Plan <br />7. The applicant has stated that the handling of fuel will conform to all local, State, and <br />Federal regulations. The operator must indicate that there is a Spill Prevention <br />Control and Countermeasure (SPCC) plan in place and that the SPCC plan will be <br />implemented prior to storage of fuel or oil products. This can be done by submitting a <br />letter to the Division, on company letterhead, affirmatively stating that the plan has <br />been implemented. The operator does not need to submit a SPCC plan to the <br />Division; however, it must be available for review at the facility or the nearest field <br />office during an inspection conducted during normal business hours. <br />8. Specify whether explosives will be used during mining per Rule 6.4.4(1).
