MINE ID # OR PROSPECTING ID #: m-9nm-n9i <br />INSPECTION DATE: Jnni inN t2L h. 9Q09 INSPECTOR=S INITIALS: ii F <br />OBSERVATIONS <br />This was a normal monitoring inspection of the Duckworth Pit, DRMS file# <br />M-2003-091. This site is located about 5.5 miles north west of the town <br />of Frederick, Colorado in Weld County. I, Jared Ebert of the Colorado <br />Division of Reclamation Mining and Safety conducted the inspection. Mr. <br />Sean Frisch of Lafarge North America, Inc. (Lafarge) accompanied me on the <br />inspection. <br />The sit is permitted for 56.50 acres, and the designated post mine land <br />use is "Recreation". The mine entrance sign was in place at the time of <br />the inspection and the permit boundary appeared to be delineated. Through <br />the mining process the operator will create two unsealed water ponds. <br />They will revegetate the areas above the waterline with native grasses, <br />and they have committed to plant various species of trees and shrubs. At <br />this time Lafarge has not begun to mine the site. According to Mr. <br />Frisch, they intend to begin mining this year. <br />The site is split into <br />parcels. Mine Phase 1 <br />west of the creek. Many pieces of equipment and <br />in this area. <br />The Smith and Emmons Ditch is located on the western half of Phase 2 and <br />runs north and south through the permit area. According to the approved <br />mining plan, Lafarge committed to relocating the Smith and Emmons Ditch <br />prior to mining. According to the "Agreement to Modify Ditch and Ditch <br />Easement," submitted by Lafarge to the Division in September of 2004, <br />Lafarge was supposed to complete the construction of the new ditch no <br />later than, December 31, 2007. It states in the agreement that, "If the <br />Installations are not completed by December 31, 2007, then this Agreement <br />shall expire and be of no force and effect". At the time of the <br />inspection, Lafarge has not re-located the ditch to the location and <br />specifications approved in the Mining and Reclamation Plan. There was a <br />small cut/ditch that has been made near the existing agricultural entrance <br />at the south west portion of Mine Phase 2. However, no other work has <br />been done to relocate the ditch. Given this information, it appears that <br />the agreement between Lagarge and the Ditch Company is no longer in effect <br />and will need to be renewed prior to the construction of the ditch. This <br />is cited as a problem at the end of this report. Lafarge is reminded that <br />they cannot begin mining until the Smith and Emmons Ditch has been <br />2
